These Terms and Conditions ('Terms') govern your use of the Smartmonies website at www.smartmonies.co.uk ('Website') and the financial literacy classes and related services we provide ('Services').

References to 'we', 'us', or 'our' in these Terms mean Aynam Limited t/a Smartmonies.
2. Acceptance of Terms
By accessing our Website or enrolling in our Services, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy (which is incorporated into these Terms by reference).
If you do not agree with any part of these Terms, you must not use our Website or Services.
Where the participant is under the age of 18, these Terms must be accepted by a parent or legal guardian ('Guardian') on the participant's behalf. The Guardian takes on all obligations and responsibilities set out in these Terms.
3. Our Services
Smartmonies provides online one-to-one and group financial literacy classes for children, primarily aged 8 to 12, delivered via video conferencing technology. Our programme covers topics including budgeting, saving, spending, and basic investment concepts.
Our classes are:

Primarily designed for children aged 8 to 12, though we may accept participants outside this range on a case-by-case basis at our sole discretion;

Delivered online by qualified educators; and

Subject to availability, which we reserve the right to change at any time.
We reserve the right to modify, suspend, or withdraw any aspect of our Services at any time with reasonable prior notice where practicable.
4. Eligibility and Registration
To enrol in our Services, you must:

Be aged 18 or over, or a parent or legal guardian acting on behalf of a child participant;

Provide accurate, complete, and up-to-date registration information; and

Ensure that child participants have your consent and supervision as appropriate.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at info@smartmonies.co.uk if you suspect any unauthorised use of your account.
5. Pricing and Payment
Current pricing is displayed on our Website. All prices are quoted in pounds sterling (GBP) and are inclusive of VAT where applicable.
Payment is due in full before the commencement of classes unless we expressly agree otherwise in writing. We use third-party payment processors to handle transactions. We do not store your payment card details on our systems.
We reserve the right to change our pricing at any time. Price changes will not affect bookings already paid for.
6. Cancellations, Refunds, and Your Right to Cancel
6.1 Your Statutory Right to Cancel (Cooling-Off Period)
If you are a consumer contracting with us at a distance (e.g., via our Website), you have the right to cancel your contract within 14 days of the date of purchase without giving any reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
If you request that we begin providing the Services before the 14-day cancellation period expires, and you subsequently exercise your right to cancel, you will be liable to pay us a proportionate amount for the Services provided up to the point of cancellation.
To exercise your right to cancel, you must notify us clearly in writing (e.g., by email to info@smartmonies.co.uk) within the 14-day period.
6.2 Cancellations After the Cooling-Off Period
After the 14-day cooling-off period, cancellation requests must be made in writing to info@smartmonies.co.uk. Our refund policy applies as follows:

Cancellations made more than 48 hours before a scheduled class: full credit for rescheduling;

Cancellations made within 48 hours of a scheduled class: no refund or credit will be issued;

Classes cancelled by us: a full credit or refund will be offered.
Refunds, where applicable, will be processed within 14 days of the cancellation being confirmed.
7. Class Participation and Code of Conduct
All participants and their Guardians agree to:

Treat teachers, tutors, and other participants with courtesy and respect at all times;

Ensure that child participants join classes in a suitable, supervised environment;
-
Not record, screenshot, or share class content without our prior written consent;
-
Not engage in any behaviour that is disruptive, abusive, or harmful to others.
We reserve the right to remove any participant from a class or programme, with immediate effect and without refund, for breach of this code of conduct. In serious cases, we may also report safeguarding concerns to the relevant authorities.
7.1 Technical Requirements
Participants are responsible for ensuring they have a stable internet connection, a suitable device (computer, tablet, or similar), and any software required (e.g., the relevant video conferencing application) to participate in classes. We are not responsible for any disruption caused by technical issues on the participant's side.
8. Safeguarding and Child Safety
The safety and wellbeing of children using our Services is our highest priority. We are committed to implementing and maintaining appropriate safeguarding measures, including:

All teaching staff are subject to Disclosure and Barring Service (DBS) checks;

Classes are conducted only via authorised, supervised platforms;

No adult should be alone online with a child outside of a scheduled class context; and
-
We will take all reasonable steps to respond appropriately to any safeguarding concern that arises during our Services.
If you have a safeguarding concern, please contact us immediately at info@smartmonies.co.uk. Serious concerns will be referred to the relevant statutory authorities.
9. Intellectual Property
All content provided during our classes and on our Website, including lesson materials, presentations, worksheets, videos, graphics, and other resources, is the intellectual property of Aynam Limited and is protected by copyright and other applicable laws.
You are granted a limited, non-transferable, non-exclusive licence to use class materials solely for your child's personal educational use. You must not:

Reproduce, distribute, publish, or transmit any of our materials to any third party;

Use our content for any commercial purpose; or
-
Remove any copyright or proprietary notices from our materials.
Breach of this clause may entitle us to terminate your access to our Services immediately.
10. Privacy and Data Protection
We are committed to protecting your personal data. Our Privacy Policy sets out in full how we collect, use, store, and protect personal information, and your rights in relation to that data. Our Privacy Policy is available at www.smartmonies.co.uk/privacy-policy and forms part of these Terms.
By accepting these Terms, you confirm that you have read and understood our Privacy Policy.
11. Limitation of Liability
Nothing in these Terms excludes or limits our liability for:

Death or personal injury caused by our negligence;

Fraud or fraudulent misrepresentation;

Any liability that cannot be excluded or limited by law, including under the Consumer Rights Act 2015.
Subject to the above, to the maximum extent permitted by law:

We shall not be liable for any indirect, incidental, consequential, or punitive losses arising from your use of our Services;

Our total liability to you in connection with any claim arising under or in connection with these Terms shall not exceed the total amount paid by you for the Services giving rise to the claim in the 12 months preceding the claim.
We do not warrant that our Website will be uninterrupted, error-free, or free from viruses. We do not accept responsibility for any loss or damage caused by reliance on information published on our Website.
12. Your Consumer Rights
If you are a consumer, these Terms do not affect your statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation. Where our Services are not performed with reasonable care and skill, you may be entitled to repeat performance or a price reduction.

13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services, applicable law, or best practice. We will notify you of material changes by email or by posting a notice on our Website at least 14 days before the changes take effect. Your continued use of our Services after that date will constitute your acceptance of the revised Terms.
The version of these Terms in force at the date of your purchase will apply to that purchase.
14. Governing Law and Disputes
These Terms are governed by English law. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you have a complaint about our Services, please contact us in the first instance at info@smartmonies.co.uk. We aim to resolve all complaints within 14 working days.
If we cannot resolve a dispute, you may have the right to use an alternative dispute resolution (ADR) scheme. Further information about ADR is available from the Chartered Trading Standards Institute at www.tradingstandards.uk.
15. General
If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions will continue in full force and effect.
Our failure to exercise or enforce any right under these Terms does not constitute a waiver of that right.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us with respect to your use of our Services.
